Welcome to the Sensei Platform’s (defined below) terms and conditions!

These terms and conditions constitute a legally binding agreement between Nirvana Consulting Group Limited (In India operated as Sensei Nirvana India Private Limited) and the user who visits the Sensei Platform (defined below) in connection with the use of our services.

Please read these terms carefully before you create an account with us or access our platform or services. These terms tell you who we are, what you can and can’t do on our platform, how we facilitate payments and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

These terms should be read alongside our Website Terms and Conditions.

These terms are binding upon you and your heirs, representatives, successors and assigns, as may be applicable. The headings of several articles and subdivisions of these terms are inserted solely for convenience of reference and shall have no further meaning, force or effect.

INTRODUCTION TO US AND THE SENSEI PLATFORM

We are Nirvana Consulting Group Limited, a company registered in England and Wales under company number 12224181 and with our registered office at 128 City Road, London, United Kingdom, EC1V 2NX (referred to as “Nirvana”, “we”, “our” and “us” in these terms). We operate the website https://sensei.global.

In India Sensei Nirvana India Private Limited markets and sells our products and services.

Nirvana operates a comprehensive platform aimed at bridging the gap between job seekers, students, and employers. We call this “Sensei”, which we make available at www.sensei.global (the “Sensei Platform”). Access to, and use of, the Sensei Platform is on a subscription basis (“Subscription”).

Where to find information about us and the Sensei Platform

You can find everything you need to know about us and our products (including our Subscriptions) on our website at https://sensei.global or from our sales or support staff (who we call “counsellors”) before you subscribe to the Sensei Platform. We also confirm the key information to you in writing after you subscribe, either by email or in your online account.

The Sensei Platform also allows you to access services offered by our trusted partners. You can find more information about the services offered by individual partners directly from them via their own website or by contacting them.

ELIGIBILITY

You represent and warrant that you are competent to enter into a valid binding contract as per applicable laws. By accessing or using the Sensei Platform, you represent and warrant that you fulfil the requirement of minimum age and have the legal capacity and authority to enter into a contract as per applicable laws.

You are not under any legal or other disability which limits your ability to comply with these terms or to use the products / services offered by us. You further represent that you are not purchasing the products / services for sale to others and will not do so without Nirvana’s prior written consent.

DISCLAIMER OF WARRANTY

Nirvana expressly disclaims warranties of any kind for any use of or any access to the Sensei Platform, to any material, information, links, or content presented on the web pages at the Sensei Platform, to any external website linked thereto, and to any external material, information, links, or content linked thereto. The Sensei Platform, and any material, information, links, and content presented on the web pages at the Sensei Platform, as well as any external website and any external material, information, links, and content linked thereto, are provided on an "as is" basis, without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose, or non-infringement. Nirvana has no control over any external website or over any external material, information, links, and content linked to the Sensei Platform. The Sensei Platform and its internal web pages may be unavailable for online access from time to time and at anytime; there are no guarantees and no warranties of online availability, impressions, and click-throughs. The entire risk as to the performance of, or non-performance of, or arising out of the use of, or the access of, or the lack of access to the Sensei Platform, to any material, information, links, or content presented on the web pages at the Sensei Platform, to any external website linked thereto, or to any external material, information, links, or content linked thereto, is borne by the user, visitor, customer, or other person.

CONSENT AND LIABILITY DISCLAIMER

Nirvana shall not be responsible for any errors or omissions contained on any Sensei Platform and reserves the right to make changes at anytime without notice. All the Nirvana and third-party information provided on any Sensei Platform is provided on an “as is” basis.

No claim as to the accuracy and correctness of the information on the site is made although every attempt is made to ensure that the content is not misleading. In case any inaccuracy is, or otherwise improper content is sighted on the Sensei Platform, please report it to report abuse.

The material, information, links, and content presented on and by this Sensei Platform is of a general nature only and is not intended to address the specific circumstances, requirements, or any other needs of any particular individual or entity. It cannot be guaranteed that the material, information, links, and content presented on and by this Sensei Platform is comprehensive, complete, accurate, sufficient, timely, or up to date for any particular purpose or use. The material, information, links, and content presented on and by this Sensei Platform should not be considered as professional, legal, business, financial, investment, or purchasing advice (if you need specific advice, you should always consult a suitably qualified professional). YOUR SENSEI PLATFORM ACCOUNT

You must create an account with us (“Account”) to access and use the Sensei Platform and our services provided on the Sensei Platform. 

You agree:

  • to provide accurate and complete information on your Account and to keep that information updated;
  • not to provide any false or misleading information about your identity or location, your business or employment status, and your skills or certifications you hold;
  • to correct any information that is or becomes false or misleading;
  • that you are responsible for safeguarding and maintaining the confidentiality of your username and password and agree not to share your username or password with anyone;
  • that you are responsible for any use of the Sensei Platform and our services associated with your Account;
  • to notify us immediately if you suspect or become aware of any unauthorised use of your Account or any unauthorised access to your password; and
  • not to use the Account or log in with the username and password of anyone else.

SUBSCRIPTION OPTIONS, FEES AND LENGTH

Subscription plans

We currently offer 3 levels of Subscription to the Sensei Platform:

  1. Free
  2. Premium 
  3. Ultimate

What is included within each level is set out on our website.

Subscription length and auto renewal

Your Subscription will start on the date we confirm acceptance of your Subscription via email.

Each Subscription is offered on the following basis:

  • Annual – your Subscription will last for 12 months

If you have the “auto renewal” option activated in your Account your Subscription will automatically renew for the same length of time as your current Subscription length and we will automatically process payment from the payment method on your Account for the applicable Subscription fees.

Subscriptions are accepted automatically 

Once you subscribe to the Sensei Platform and have made payment we contact you via email to confirm we've accepted your order. 

We charge you for a Subscription as soon as you subscribe

When you first subscribe to the Sensei Platform we charge you immediately. However, depending on which plan you subscribe to we may take further payment at regular intervals, as explained to you during the subscription process. 

Upgrading or downgrading your Subscription

Upgrading

You can upgrade your Subscription level at any time. You can do this in your Account settings.

When you upgrade the fees due will be equal to the prorated amount for the remainder of the current Subscription period based on the price difference between the level you are currently on and the upgraded level. The fees will be payable immediately at the time of the upgrade. Your Subscription will then be renewed as per the “Subscription length and auto renewal” section above.

Any additional services as part of the upgrade will be available immediately.

Downgrading

You can downgrade your Subscription level at any time. You can do this in your Account settings OR by contacting us from Contact Us page on the website.

Currently, we do not offer downgrading your Subscription plan from annual to monthly.

When you downgrade, we do not offer refunds for any prepaid and unused portion of a Subscription period based on a higher level. Your Subscription will then be renewed as per the “Subscription length and auto renewal” section above.

Downgrades may result in the loss of access to certain services and features associated with the higher subscription level. You are responsible for saving any data or content that may be affected by the downgrade.

We charge interest on late payments

If we are unable to collect any payment you owe us, we charge interest on the overdue amount at the rate of 3% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgement. You pay us the interest together with any overdue amount. 

We pass on increases in sales or value-added tax or goods and service tax

If the rate of the applicable sales tax or value-added tax or goods and service tax (depending on which country you live in) changes between your subscription date and the date we supply the product, we adjust the rate of sales tax or value-added tax that you pay, unless you have already paid in full before the change in the rate takes effect.

CHANGING YOUR MIND OR CANCELLING YOUR SUBSCRIPTION

Your legal right to change your mind. You have a “cooling off period” within which to change your mind about subscribing to the Sensei Platform. The cooling off period applicable to you will depend on which country you live in (as set out in the table below). The cooling off period starts after the date we confirm your Subscription. You lose the right to cancel the Subscription:

  • once you have started to download or stream any digital product on the Sensei Platform (such as our job markets insight data or self learning courses).

How to let us know and what happens next. If you change your mind contact our Customer Service Team: fill in the “Contact Us” form at sensei.global/contact-us. We will refund you as soon as possible and within 14 days of you telling us you've changed your mind. We refund you by the method you used for payment. We don't charge a fee for the refund.

Your right to cancel the Subscription

You may cancel your Subscription at any time. Your Subscription will then end:

  • for annual plans – the day after the last day of the relevant 12 month period

Subscription fees will be due in full until the end of the Subscription. You will continue to have access to the Sensei Platform until the end of your Subscription.

Your rights if there is something wrong with the Sensei Platform

If you think there is something wrong with the Sensei Platform, you must contact our Customer Service Team: sensei.global/contact-us. Your legal rights will vary depending on the country that you live in and your statutory rights will be unaffected. Remember too that you have several options for resolving disputes with us.

Please note that the Subscription fees paid by you are for access to the Sensei Platform and the market insight data and self-learning modules only. Whilst we offer other services on the Sensei Platform these are provided as a goodwill offering only. We will try our best to fix any issues with these additional services but such issues will not entitle you to cancel your Subscription.

CHANGES TO THE SENSEI PLATFORM AND THESE TERMS

Changes we can always make. We can always make a change to the Sensei Platform:

  • to reflect changes in relevant laws and regulatory requirements. This may result in the removal of certain services or data points from the Sensei Platform;
  • to make minor technical adjustments and improvements, for example, to address a security threat. These are changes that don’t affect your use of the Sensei Platform; and
  • to update digital content, provided that the digital content always matches the description of it that we provided to you before you subscribed to the Sensei Platform. We might ask you to install these updates.

Changes we can only make if we give you notice and an option to terminate. 

We can also make certain significant changes to the Sensei Platform or these terms, but if we do so we’ll notify you and you can then contact our Customer Service Team: sensei.global/contact-us to end the subscription before the change takes effect and receive a refund for any Subscription fees you've paid for in advance, but not received.

We can suspend access to the Sensei Platform or specific products

We do this to:

  • deal with technical problems or make minor technical changes;
  • update the product to reflect changes in relevant laws and regulatory requirements; or
  • make changes to the product (see We can change products and these terms).

We may also suspend access if:

  • you do not pay the Subscription fees when due; or
  • one of our provider’s stops providing us access to a specific product.

We let you know, may adjust the price and may allow you to cancel. 

We contact you in advance to tell you we're suspending access to the Sensei Platform, unless the problem is urgent or an emergency. If we suspend access for longer than 7 days in any 30 day period  we adjust the price so you don't pay for it while it's suspended. If we suspend supply, or tell you we're going to suspend supply, for more than 14 days you can contact our Customer Service Team: sensei.global/contact-us to end the Subscription and we'll refund any sums you've paid in advance for the Subscription but won't have access to the Sensei Platform.

We can withdraw products offered on the Sensei Platform

We can stop providing a product on the Sensei Platform, such as an ongoing service or specific digital content, at our sole discretion. For significant changes we will let you know at least 30 days in advance if we plan to do this and we refund any sums you've paid in advance for products which won't be provided. Minor changes we are not required to notify you of.

WHEN WE CAN END OUR CONTRACT WITH YOU

We can end our contract with you and claim any compensation due to us if:

  • you don't make any payment to us when it's due and you still don't make payment within 7 days of our reminding you that payment is due;
  • you don't, within a reasonable time of us asking for it, provide us with information, cooperation or access that we need to provide the product; 
  • at any time you provide false, inaccurate, or incomplete information in creating, marketing, or maintaining an Account (including sharing logins with someone other than you).
  • you breach our Community Guidelines; or
  • you materially breach any provision of these terms and conditions.

OUR LIABILITY TO YOU

We don't compensate you for all losses caused by us or the Sensei Platform

We're responsible for losses you suffer caused by us breaching this contract unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your Subscription meant we should have expected it (so, in the law, the loss was unforeseeable).
  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section We're not responsible for delays outside our control. 
  • Avoidable. Something you could have avoided by taking reasonable action. For example, damage to your own digital content or device, which was caused by digital content we supplied and which you could have avoided by following our advice to apply a free update or by correctly following the installation instructions or having the minimum system requirements advised by us.
  • A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

LIMITATION OF LIABILITY

In no event and under no circumstances and under no legal theory, tort, contract, or otherwise shall we and / or any of our affiliates be liable, without limitation, for any damages whatsoever, including direct, indirect, incidental, consequential or punitive damages, arising out of any access to or any use of or any inability to access or use this Sensei Platform including any material, information, links, and content accessed through this Sensei Platform or through any linked external website/application.

Notwithstanding anything contained in this contract, our and / or any of our affiliate’s maximum liability shall be the lesser amount of the following two: (a) the actual loss or damage incurred by you; or (b) amount paid by you for availing our services under this contract. 

OUR PARTNERS 

These terms and conditions relate only to the provision of the Sensei Platform by us to you.

Some of the services offered on the Sensei Platform are offered, and provided, by our trusted partners (for example universities, training partners etc.). Our role is limited to acting as an intermediary only in these scenarios. Your use of a partner’s services is entirely at your discretion and if you do choose to use a partner’s services you will be required to enter into a direct contract with that partner.

We do not accept any liability directly related to our partners.

In some scenarios we may earn a commission by referring you to one of our partners.

OUR INTELLECTUAL PROPERTY

You acknowledge and agree that Nirvana and/or its licensors own all intellectual property rights in the Sensei Platform. 

These terms do not grant you any rights to, under or in, any patents, copyrights, database rights, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights or licences in respect of the Sensei Platform.

HOW WE WE USE PERSONAL DATA

How we use any personal data you give us is set out in our Privacy Notice: sensei.global/privacy-policy.

HOW YOU CAN COMPLAIN AND RESOLVING DISPUTES

You have several options for resolving disputes with us

Our complaints policy. Our Customer Service Team: sensei.global/contact-us will do their best to resolve any problems you have with us or the Sensei Platform as per our Complaints Policy.

Resolving disputes without going to court. Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. You can submit a complaint to us through our website at sensei.global/contact-us. Nirvana does not charge you for making a complaint and if you're not satisfied with the outcome you can still go to court. 

You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts.

OTHER IMPORTANT TERMS THAT APPLY TO OUR CONTRACT WITH YOU

We're not responsible for delays outside our control. If our supply of the Sensei Platform is restricted due to an event outside our control, we will contact you as soon as possible to let you know and do what we can to reduce the restriction. As long as we do this, we won't compensate you for the restriction, but if the restriction is likely to be substantial you can contact our Customer Service Team: sensei.global/contact-us to end the contract and receive a refund for any Subscription fees you have paid for in advance, but not received, less reasonable costs we have already incurred. 

We can transfer our contract with you, so that a different organisation is responsible for supplying the Sensei Platform. We'll contact you to let you know if we plan to do this. If you're unhappy with the transfer you can contact our Customer Service Team: sensei.global/contact-us to end the Subscription within 14 days of us telling you about it and we will refund you any payments you've made in advance for any period when the Sensei Platform will not be provided.

You can only transfer your contract with us to someone else if we agree to this.

Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

MISCELLANEOUS

Entire Agreement

These terms as amended from time to time constitute the entire agreement between you and us regarding the Sensei Platform.

No advertisements, catalogues or other publications or statements, whether written or oral, regarding the performance of the Sensei Platform permitted under these terms shall form part of these terms.

Severability

Void provisions shall have no effect on the validity of other parts of these terms.

If any provision of these terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these terms shall remain in full force and effect.

Assignment and Delegation

You may not assign or delegate your rights under these terms, and any assignment and/or delegation of these terms or any sub-licensing by you will be null and void.

Availability of Services

Services are provided on a best efforts basis on an ‘AS IS’ and ‘AS AVAILABLE’ basis, all is on a best efforts basis.

Any regulations, guidelines, legislations or lawful orders of a court or a quasi-judicial body may require us to change, alter or stop our services. Similarly, any force majeure events which are beyond our reasonable control, may cause an interruption in the services.

Schedule 1: Content Specific Terms

Job Market Insights Data 

The job market insights data available on the Sensei Platform is sourced from various partners and then curated by our team. We strive to ensure the data is as accurate as possible but you must take the data as indicative only and it should be used in conjunction with other data points available to you outside of the Sensei Platform. 

To the greatest extent permitted we accept no liability for data inaccuracy.

Course content (self learning modules) 

Our course content is sourced from multiple partners through our main strategic partner and is not created by us. Ownership of specific course content lies with the relevant content owners. 

Due to the various partners we use, content may be in different learning formats.

The Sensei Platform provides certification for completion. The certification is not similar to or recognised by a government or educational institution issued certification board and is purely based on Nirvana’s assessment and business rules. 

From time to time our partners need to update, or stop providing altogether, certain course content. In these scenarios we will then need to remove the relevant content from the Sensei Platform, either immediately or at some point in the future. We will try our best to ensure that you can finish any course that you have started.

  • Future removal – for a course that you have started we may allow you to access the course for few weeks after decommissioned or until you complete it or your Subscription ends (whichever comes sooner)
  • Immediate removal – where a specific course that you have already commenced will be removed with immediate effect we will notify you of removal in advance either through email notification or on community. We may offer you a refund of the Subscription fees (or a portion thereof) at our sole discretion.

To the greatest extent permitted, we accept no liability for content provided by our partners.
